Foreign transferors that are dealers in securities seeking a withholding exception, and foreign sellers of life‑insurance contracts or interests whose income is effectively connected, must file IRS Form W-8ECI.
The form collects the filer’s name, permanent residence address, U.S. business address, U.S. TIN (SSN, EIN, or ITIN), foreign tax identifying number or a check that an FTIN is not legally required, and a certification on line 12, followed by a signature in Part II.
Give Form W-8ECI to the withholding agent or payer requesting it, not to the IRS, and provide it before the payment is made, credited, or allocated.
First, enter the name on Part I line 1. Provide the permanent residence address, then the U.S. business address on line 6 (no PO boxes). Supply a U.S. TIN on line 7 and either the FTIN on line 8a or check line 8b if an FTIN is not required. Complete the certification on line 12, then sign Part II under penalties of perjury. Deliver the signed form to the withholding agent before any payment.
If the form is not provided, the withholding agent must withhold at the 30% rate or the backup withholding rate, and false statements can trigger penalties under perjury provisions.
